Terms of Service

1. Who we are

ImageWhim (the "Service") is operated by Yang Junwei ("we", "us"), a sole proprietor. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

The Service lets you generate and edit images from text prompts and optional reference images using third-party artificial intelligence models. The models currently available are OpenAI GPT Image 2.5 Flare, OpenAI GPT Image 2.5 Sunburst, accessed through the official OpenAI Images API. All images produced by the Service are AI-generated and are labeled as such in the app. AI output can be inaccurate, unexpected or similar to output produced for other users. We do not guarantee that the Service will be uninterrupted or that any particular result can be achieved.

3. Accounts

You must be at least 18 years old to use the Service. You must provide a valid email address, keep your password secure, and are responsible for all activity on your account. One person may not operate multiple accounts to obtain additional free credits.

4. Credits, prices and payment

  • Image generation consumes credits. The number of credits per image depends on model, quality and size and is shown before you generate, and on our Pricing page.
  • Credits are sold in one-time packs. Prices are shown in US dollars; applicable sales tax or VAT is calculated at checkout based on your location.
  • Credits have no cash value, are not transferable and do not expire while your account remains open.
  • If a generation fails, the credits for it are returned to your balance automatically.
  • Free credits granted at sign-up or in promotions are promotional, may be changed or withdrawn, and cannot be refunded or exchanged.
  • Our order process is conducted by our online reseller Waffo Pancake. Waffo Pancake is the Merchant of Record for all our orders and handles payments, sales tax and refunds.
  • Refunds are governed by our Refund Policy.

5. Acceptable use

You must follow our Acceptable Use Policy. We use automated filters and our AI providers' safety systems, may refuse any request, and may suspend or terminate accounts that violate it.

6. Your content

You keep any rights you have in the prompts and images you submit ("Inputs"). You confirm that you have all rights and permissions needed to submit Inputs, including the consent of any person shown in them. You grant us a limited license to process Inputs solely to operate the Service. As between you and us, you own the images generated for you ("Outputs"), to the extent permitted by law and by the terms of our AI model providers. You are responsible for how you use Outputs, including making sure they do not infringe third-party rights.

7. Third-party services

Images are generated with OpenAI GPT Image 2.5 Flare, OpenAI GPT Image 2.5 Sunburst, provided by OpenAI through its official API. ImageWhim is an independent product and is not affiliated with, endorsed or sponsored by OpenAI. Payments are processed by our payment provider Waffo Pancake. Your use of these services may also be subject to their terms.

8. Termination

You may stop using the Service and ask us to delete your account at any time. We may suspend or terminate your access if you breach these Terms or the Acceptable Use Policy, or if required by law. Credits on accounts terminated for violations are forfeited.

9. Disclaimers and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, to the extent permitted by law. To the maximum extent permitted by law, our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental or consequential damages. Nothing in these Terms limits rights you have under mandatory consumer protection law.

10. Changes

We may update these Terms. We will post the new version here with a new date and, for material changes, notify you by email. Continued use after the change means you accept the updated Terms.
